Forced displacements, such as those in Gaza, constitute a violation of international humanitarian law, particularly Article 49 of the Fourth Geneva Convention, which prohibits the forced transfer of protected persons by an occupying power. Israel’s actions, including the issuance of “evacuation” orders covering vast areas of Gaza, have led to the displacement of 85% of the Gazan population, according to estimates. Families have been displaced multiple times, only exacerbating an already critical situation. The lack of safe routes and clear destinations raises concerns about the right of return for displaced persons and constitutes a forced transfer.
We are horrified at the prospect of a ground invasion in Rafah, which would be absolutely catastrophic for the population of one and a half million people currently registered there (including one million displaced persons). In Rafah, the population has nowhere to go as the north and center of Gaza are bombed daily. Reports of Israeli plans aimed at permanently displacing Palestinians from Gaza to other territories, such as the Sinai Peninsula or third countries, are alarming.
In light of these serious concerns, we call on governments worldwide to do everything in their power to:
- Actively work towards an immediate, permanent, and unconditional ceasefire.
- Ensure that Israel complies with all its obligations under international law and the provisional measures ordered by the International Court of Justice.
- Reject and prevent any initiative that could contribute to the forced, permanent, or prolonged displacement of Palestinians and ensure the safe return of all displaced Palestinians to Gaza as soon as hostilities end.
- Facilitate immediate access to humanitarian aid in Gaza, including the delivery of essential goods and supplies to meet the needs of the population, particularly the most vulnerable groups.
- Fully uphold their legal obligations under the Geneva Conventions and customary international law to ensure respect for international humanitarian law.
We urge the international community to take firm action to address the distress of Palestinians in Gaza and uphold their rights in accordance with international law.
